man's 1987 death at Sporn plant

The targost selllemcnt in Mason
County and possibly the Slate of
West Virginia was tried Wednesday,
according to Attorney Ronald R.
"Randy" Morgan . II, and set~cd by
a jury that deliberated over their
fl nal decision for more than fl vc
hours.
Daphne Pasquale and her
children, Toby and Ashley (who
was seven weeks old at the time of
the accident), were awarded over
$6 million after Michael David
Pasquale of Gallia County was ktlled at the Philip Sporn Plan! in
Graham Station, near New Haven.
in August 1987.
The famil y was awarded
$ 1,174 ,712 to com pensate for the
ant icipated loss of in come and services such as protection , care and
ass istance when Pasquale was killed on Aug . 19, 1987.
An01her $5 mrllwn was added to
the sum for sorrow. so lace, mental
angu ish and the loss of comfort and
guidance, making the grnnd total
$6.174,712.
In addition LO the monetary compensauon. the JUry also found no
fault on the pany of M1chael D.
Pasquale.
The incident took place when
Pasquale was an invitee at the
Philip Sporn Plant, according to
Morgan . He was wid to do a JOb in
the Unit 5 working section .
A problem occurcd in the Ullll 2
divisiOn of the plant and the power
company directed the men 10 that
panicular area. While worting,
Pasquale cut mto a 2,300 volt
electric line, instantly electrocuting
and killing him, Morgan staled.
The lawyers who represented the
Pasquale family were Morgan, a
practicing lawyer in Point Pleasant,
and Harvey Peyton, an attorney
who has offices in Nitro and Charleston.
Followmg the incident, Morgan
and Peyton filed a wrongful death
action against the Philip Sporn
Plant.
''The power company had every
opportunity to Set~e the case. They
just simply refused to seUle for a
reasonable sum of money. This particular case has been pending for
three years." said Morgan.
"I believe that we won the case
because of a combination of factors. Peyton, who assisted in the
trial, was superb. In fact, I believe
thai he was beuer than 'Matlock'
on television. What happened to
Michael Pasquale was a terrible,
terrible tragedy. I thought that we
would win, but I never thought the
decision would be this large. It is
well deserved, but there has nevtv
been such a large sum presented to
any plaintiff in Mason Coonty his·
tory, " Morgan continued.
The only opportunity that the
Ohio Power Co. and the Central

Operating Company, parent companics of the Philip Sporn Power
Plant, can do now to get the deci·

sion changt:d. is 10' file an appeal
