Cleveland had broqht 1111t,
through his attorney. pleading for reapportioning membership of the Ohio Houae of Representative.,
with apportionment to be baNd on the 1851 ConstitutiOll Ohio. The Supreme Court. In lune of t1t11
year, granted Mr. Nolan's petition, and, ordered the Ohio House of Representatives reapportioned oa
atrictly a population basis. The 1851 Conotitutlon, he 1ald, provided for opportlonlng lOlntamltert el
the Houoe on a population bulo and this remained in effect until 1904 when an tllllltldmnol, prwo
iouoly approved by vote of the people, continued this population basis foor membership In the Hinlae,
except. that each county should have at least one repreuntativt. WELKER Hid thia provllloa ba4
been in effect for the past sixty yean;.

or

or

Soon after the Supreme Court decision was rendered In June of lhll year, Mr. Nolan dtllltmdedl
of the Court that this order be placed In effect forthwith. The Attorney General, Mr. Sube, on bthllf
of the State of Ohio, asked the Court for time oo that the General Assembly might submit a pl.u to tM
Court for reapportioning. WELKER aaid It waa hia underatondlnl no tlnll dtclllon had been 1111de,
but, committees of the House were making Jludita for the purpose of submlttlne a reapportionment
plan to the Court. He said no doubt when the final plan iJ approved by the General Assembly and the
Court, it would have to be submitted to the people in the form of a collilitutlonal amendmut to be
voted on by the people.
Before Congress adjourned, WELKER oald, a bill had passed the U. !1. House of RapruentaUvu
that would have stopped the Supreme Court decision from going Into effect, but Prtlldtnt Joi!Dio11
prevented the Democrat-controlled Senate from paning tbat bJII.

'
WELKER said bluntly, if this Supreme Court deciAlon 11 ollowed to stand, MEIGS County and
some foriY-seven other counties will lo1e their state representatives. He said under that Court order
the large citieo of Ohio would have moot of the representatives and he felt aure thia would 1101 be for
the bestlnteresto of Ohio, especially from a taxation viewpoint. In addition to reapportioning the Gen·
era( Assembly, WELKER said, this unprecedented decision of the Supreme Court could bo extended
to all local governments and could cause many county courthouses w become only sub-alation for far·
ger counties.
'

WELKER stressed this point in particular. He said a candidate of either the Republican or Democrat Party tiling his petition of candidacy for the Hou1e of Representatives tokes an oath that he will
support the national and state platforms as adopted by their respective parties, and, he sold, he and
hi• Democrat opponent signed such an oath. He pointed out that delegates to the Republicaq National
Convention in San Francisco adopted a plank in their platform oppo1lng the Supreme Court'• doclslon
of meddling in reapportioning of state legiolature~. The platform adopted by the RepubUcan State
Convention In Columbus on September 17, thl• year, adopted a hands-off policy on reapportioning
too. l'!ut, WELKER said, thia Year both the Democrat National and State Convenllo!ll unanllnoully
adopted planks In their platforms plodglna full 1upport ef rooppertlon-nt.
In the light of the oath which he and l subscribed to when we filed a• opposing candldat11 fDI'
MEIGS County State Representative, WELKER asked this question: '"Where does this leave my Democrat opponent?" WELKER laid, "! am unalterably opposed to MEIGS County losing Its stale representative," and he •aid he wao sure tho votaro of MEIGS County should know theoe faclll before Novelllber 3. WELKER said if the votero of MI!IGS county elect him as their state representative they ca11
count on "my doing everythin& possible to prevent such a traeedy from happening and I 111111 honor
mY oath to do just that."
WELKER said the paramount Issues before the voten of Ohio and MEIGS County were, I!Ofto
gresslonal redistricting, reapportioning of the Ohio House of Repre•entativea, and a balanced budpt
next year with no new taxes. He taid the sound bu1iness methods adopted by Governor Rhode~ in the
management of the state'• busineu bad paid off an 83 million dollar deficit and we IIOW bad some
money in the bank. The BS milllon dollars would not have to be paid off again next year, and with •
c~ntinuatlon of •ound buslneso practices he felt •u re there would be more money for the schoolll and
other necessary functions of state aovernment without any new or Increased taxes.
