Jam-Up In Traffic Court

j

Tbe chaotic misapplication of justice
., the nation's traffic courts is surely no
;pnall factor in the mounting disregard
for law and order which marks this ace.
. In the view of the American Bar AASociation, which has a permanent

p~

iram lor the improvement of t r a ·f f i c
eourts, they produce an avalanche of
l!astily reached decisions leading to penalties that in some cases are far too II!·
-(el'e and in others too lenient.

A clrivor who ran a stoplight at a fan·
taslic 100 miles an hour, struck another
and killed two persom while lnjur·
i\,g five others, wound up with a $22

w

~e.

' Unnumbered individuals arrested for
traffic violations never actuaUy get into
the eourt aystem at all. Cities and towns
au over the country have their "scoff.
taws" who flout the traffic summons.
Chicago has a pile of four million forgotten summonses in a court building
~~astment. Now and then a scofflaw IJ
caught. One city recently crowned a new
king who had ignored more than 200
tickets.
· Meantime, the grnbby mills of many
traffic courts are raking In money from
thousands of "guilty pleaders" and an
only slightly smaller number of protestIng defendants wbo may get no more
than two minutes to make their caae.

A city traffic court which beard 66.000 apeedinJ and traffic light cases in
1960 acquitted only five defendanta. A
flock of cities frankly depend on trat ·
ftc fines to help balance their budgets,
and flitly order judgeo to "bring in
more money" when the take is lagging.
The American Bar Association now
often a consultant field service to help
Interested traffic court officials at atile·
vela. Tbe aim, of course, is to apply decent atandard• which wUI aasure justice
and efficient court operation.
Above all, thil meano allowing defendanta time to present their ~ases and
a chance to question their accusers. UnIform procedures, adequate clerical personnel, techniques for educating offendIng motorlata are also adviaed by ABA.
Moat experts say the courta have no
business aerving as revenue producers.
Some would abollab totaUy the system
of fines, and direct ali minor penalties
toward reotrlctlne or revoking drlvlne
privileges.
Profesalonal legal judgment IJ clearly
that traffic court juatlee in thil country
has largely broken down. With 75 mil·
lion motor vehicles on the roads and mil·
liona more coming, complete collapae IJ
the harsh prospect unless modernization
programs Uke the ABA's are given wide
and contlnulnc public aupport.
