Heritage Festival a home run

POMEROY — A writ of mandamus
was ﬁled by the Meigs County Home
Rule Committee on Monday morning.
Members of the committee are listed
as Paul K. Strauss, Gregory D. Howard,
Dennis Jay Sargent, Kathy Lynn Sargent
and Marsha Nagy Whitton. According to
the documents, the mandamus asks the
Meigs County Commissioners to certify
the petition that was brought to the
Board of Elections in a timely manner.
According to a legal deﬁnition, a
mandamus is “a writ or order from a
court or superior jurisdiction that commands an inferior tribunal, corporation
or municipal corporation, or individual
to perform, or refrain from performing, a
particular act, the performance or omission of which is required by law as an
obligation.”
The ﬁling comes after a July 14 special
meeting in which the commissioners
took no action regarding the petition initiative from the committee.
According to Meigs County Commissioner Randy Smith, the motion died
during the July 14 meeting because the
Board of Elections was to provide the
commissioners a certiﬁcation of both the
signatures and the validity of the petition
itself, along with a report. This information was to be delivered to the commissioners no later than 120 days before the
general election, which would’ve been
July 6. Smith said that on July 2, the
commissioners received a letter from
Director Becky Johnston and Deputy
Director Meghan Lee. The letter told
the commissioners that the petition had
been ﬁled with the Meigs County Board
of Elections on June 24, and that at least
567 signatures (the minimum required
amount) on the petition were valid.
However, according to Ohio Revised
Code 307.95, the Board of Elections,
and not the deputy director and director,
must send the certiﬁcations and report
to the commissioners. Smith said a letter
was sent back the same day, July 2, to
inform the Board of Elections of this.
According to the commissioners and
the Meigs County Home Rule Committee, the Board of Elections had a special
meeting July 13 and sent the commissioners the certiﬁcations and report the
same day. From there, the commissioners
had until 4 p.m. July 15 to pass a resolution for the petition. During their 11 a.m.
July 14 meeting, the motion died for lack
of a second because the Board of Elections turned in their certiﬁcations and
report to the commissioners a week after
it was due, which would have been July
6 — 120 days before the general election,
according to the Ohio Revised Code.

But you can’t take that to the bank: Most of the
savings claimed by the Obama administration are
unlikely to be realized, the Health and Human Services inspector general’s ofﬁce said in its own recent
analysis.
A more realistic estimate, the department’s watchdog said, is that $133.2 million in bogus payments
may be recovered or stopped before money goes
out. That would put the actual return to taxpayers at
about $3 per dollar spent. That return-on-investment
calculation is based on the cost of operating Medicare’s high-tech Fraud Prevention System, now in its
fourth year.
The huge difference between the numbers is
because the administration takes credit for all problem payments identiﬁed by the system. The inspector
general doesn’t dispute the bigger number but calls
it “unadjusted,” and only gives credit for payments
likely to be recovered or stopped.
The higher estimate of $454 million includes actual
and projected savings that “may not be recovered,”
said the inspector general’s report. The lower estimate of $133 million represents savings that “reasonably can be expected,” based on historical patterns.
Such caveats haven’t dampened the administration’s
exuberance.
“Very few investments have a 10-to-1 return on
taxpayer money,” acting Medicare Administrator
Andy Slavitt said in a celebratory statement touting
the larger ﬁgure. A former tech executive, Slavitt has
been nominated by President Barack Obama to be
administrator of the Centers for Medicare and Medicaid Services, which runs health insurance programs
for more than 100 million U.S. residents.
Fraud costs the health care system tens of billions
of dollars each year, and countering it is a top priority. The fraud prevention computer system was meant
to elevate Medicare’s game, putting it in the same
league as major credit card companies that can freeze
accounts proactively.
It’s not the ﬁrst time there’s been less than meets
the eye to upbeat health care numbers from the
Obama administration. Last year, ofﬁcials acknowledged they had overcounted the number of people
signed up for private insurance under the Affordable Care Act. That discrepancy was uncovered by
Republican investigators for the House Oversight and
Government Reform Committee as they scrutinized
sign-up spreadsheets.
“I don’t think there’s anybody misleading the public,” Shantanu Agrawal, Medicare’s director of program integrity, said of the fraud prevention numbers.
The administration’s higher ﬁgure also serves as an
indicator of the system’s preventive potential, he said.
The anti-fraud system “is more than paying for itself and
is showing improvement year over year,” Agrawal said.
But the inspector general also raised questions
about whether Medicare’s computer system is getting
more credit than it is due for some investigations.
The audit cited a case in which other sources had
already identiﬁed service providers whose billing patterns appeared suspicious. Then, the computer system
came up with an additional two providers linked to that
investigation. Medicare identiﬁed a total of $16 million
in potential savings or recoveries overall. The high-tech
system got credit for the entire amount.
Medicare pays more than 4 million claims a day,
worth about $1 billion. Partly because of a congressional mandate to pay promptly, the agency has often
been steps behind the fraudsters, a self-defeating
situation that investigators call “pay and chase.” That
seems to be changing, with stronger, more coordinated enforcement and heavier penalties.
The fraud prevention system is supposed to be a
linchpin of the new approach. But it has involved a
learning curve.

GAHS youth track camp
CENTENARY, Ohio — The Gallia Academy
track and ﬁeld program will be hosting a track camp
July 21 through August 8 to all kids in grades 1-6.
The cost is $25 per kid and you must sign a waiver
form upon arrival. Camp will be every Tuesday
and Thursday from 6:15 p.m. until 7:15 p.m. at the
new Gallia Academy High School track complex.
The camp staff will be working with kids on the
basics of track and ﬁeld. The main focus will be on
long jump; instructed by Capital University Stand
out and former state champion and school record
holder Logan Allison. Sprint mechanics, pace work
for distance events and basic techniques in the shot
put and high jump for the older kids. Events may
vary based on participation. At the end of the camp,
there will be a small meet so that the the kids can
display the skills they have been working on. Free
t-shirts will be provided to the ﬁrst 25 campers, so

Kyle Busch races to 3rd win of year
LOUDON, N.H. (AP) — Stuck
in a hospital, Kyle Busch could
only think about a comeback, not
championship contention.
Could Busch imagine, days after
a horriﬁc crash, he would become a
title contender?
“Yeah, right,” he said. “You’re
crazy.”
Nothing seems preposterous
these days for Busch, whose
dormant-to-dominant run over the
last two months has not only made
him a regular in victory lane, but
steamrolled him toward the cusp of
a Chase berth.
Busch rolled on Sunday at New
Hampshire Motor Speedway, winning for the second straight weekend and the third time in the last
four NASCAR Sprint Cup races.
“This is something I’m not sure
we ever would have expected,”
Busch said.
Busch isn’t where he needs to
be in the standings quite yet. His
three wins are certainly enough to
earn a Chase for the Sprint Cup
championship berth. He’s still outside the top 30 in points, which is
the second major qualiﬁer to race
for the title in the ﬁnal 10 races of
the season.
Busch won at Sonoma Raceway
and last week at Kentucky Speedway and is 33rd in the standings,
58 points behind David Gilliland
for 30th.
Cole Whitt is 31st and Brett
Mofﬁtt 32nd, easy pickings for
Busch.
“I’m not sure we’ve unleashed
the beast at all,” Busch said.
Busch broke his right leg and
left foot in a crash the day before

the season-opening Daytona 500.
He missed the ﬁrst 11 races of the
season, then returned in late May
determined to earn a playoff spot.
Busch, who last won at New
Hampshire in July 2006, said Friday he still is bothered by the leg
injuries. The aches hardly seemed
to matter in the No. 18 Toyota.
“We’ve got to keep doing our
deal,” Busch said. “Every week it
keeps getting better and better.”
Busch has gained 70 points on
the 30th spot over the last two
races and is not only a threat to
qualify for the Chase — but to win
it all for Joe Gibbs Racing should
he crack the 16-driver ﬁeld.
“Ever since that injury, he’s been
on it,” Gibbs said. “I don’t know
what (the deﬁcit is) now but it’s
sure helping.”
With Busch in the ﬁeld or not,
JGR has three other contenders in
Carl Edwards, Denny Hamlin and
Matt Kenseth. Kenseth ﬁnished
sixth, Edwards started from the
pole and was seventh, and Hamlin
14th. JGR took four of the top-ﬁve
spots at Kentucky. Busch won and
Hamlin-Edwards-Kenseth went
3-4-5.
“I think we’re certainly back,
closer,” Gibbs said. “I don’t know
that we’ve turned the corner.”
NASCAR granted Busch a waiver upon his return that made him
Chase eligible, should he qualify.
He has seven races left to crack
the top 30 before the Chase opens
Sept. 20 at Chicagoland Speedway.
Busch had one of his best performances in his comeback, rallying
from a lap down to win. Busch,
who led 95 laps, stayed out during

a late pit stop to take the lead from
contenders Brad Keselowski and
enseth.
Keselowski was second, followed
by Kevin Harvick, Joey Logano and
Dale Earnhardt Jr.
Keselowski led a race-high 101
laps and his No. 2 Ford appeared
the car to beat, leaving him clearly
irked at losing the lead with 48
laps left.
How tough would it be to beat
Busch in the Chase?
“He’s good,” Keselowski grumbled, “but we’re a good team and I
feel like we can beat him.”
Crew chief Adam Stevens, in
his ﬁrst season calling the shots
in Cup for JGR, made all the right
choices to keep Busch in contention for the win and a crack at the
top 30.
“I don’t have any fears of being
able to close that gap,” Stevens
said.
Busch was joined by son Brexton, born in late May, in victory
lane wearing a No. 18 outﬁt. He
should have borrowed his son’s
bibs for the winner’s 21-pound
lobster he was awarded in victory
lane.
He also made it 12 different winners at the last 12 New Hampshire
races, the longest active streak at
any track without a multiple-race
winner in NASCAR.
On a day with temperatures
soaring into the 90s, Matt DiBendendetto and Michael Annett were
treated after the race at the NASCAR care center.
“This is one of the warmest days
I can remember in this part of the
country,” Busch said.

BALTIMORE — DaMarcus Beasley was content
with his December decision to retire from the U.S.
national team.
“I have a 16-month-old daughter now, Lia, and I
wanted to watch her grow,” the 33-year-old defender
said. “If I had went to that January camp, if I wouldn’t
have retired, I would have missed her ﬁrst steps. And
those are things that I didn’t want to miss.”
Now he’s back with the Americans, who play Jamaica on Wednesday in Atlanta for a berth in the CONCACAF Gold Cup ﬁnal. U.S. coach Jurgen Klinsmann
called him last month, when the U.S. was in Europe
for exhibitions at the Netherlands and Germany.
“He left me voice mail. I ﬁgured it was just about,
how you doing? What’s going on?” Beasley said one
afternoon at the team hotel in Baltimore. “I didn’t
think I would ever receive that call, but it’s a call that
deﬁnitely was exciting.”
In his second season with Major League Soccer’s
Houston Dynamo, he had hoped to get away for a day
to visit one of the Beasley National Soccer School’s
camps in Indiana, Ohio or Michigan. Instead, he
reported for the knockout rounds after Klinsmann
added him to the roster along with forward Alan Gordon and midﬁelder Joe Corona. Beasley used FaceTime on the bus back from the practice ﬁeld Friday to
keep in touch with some of his campers.
“I asked them who they wanted to see that was on
the bus,” he explained. “Obviously, Michael Bradley.
They want to see Clint Dempsey. They want to see
Kyle Beckerman. They love the Rasta hair. They got
on FaceTime and talked to the kids.”
Born in Fort Wayne, Indiana, Beasley won the Silver Ball as the U.S. ﬁnished fourth at the 1999 FIFA
Under-17 World Championship, where Landon Donovan was selected top player. He made his national
team debut and went on to score 17 goals in 121
international appearances and become the ﬁrst American to play in four World Cups.
At the club level, he was the ﬁrst American to reach
the European Champions League semiﬁnals, with
PSV Eindhoven against AC Milan in 2005.
“DaMarcus has been on the national team forever,
and as soon as he walks in the room demands instant
respect,” goalkeeper Brad Guzan said. “All the boys,
they love when he’s in, obviously.”
Beasley won Gold Cup titles in 2002, ‘05, 07 and
‘13 and is hoping to add a ﬁfth this week. He did not
play in Saturday’s 6-0 rout of Cuba because of a calf
injury. Players say his energy and smile are infectious.
“Maybe not the biggest talker, but when he has
something to say, he says it, and guys listen,” American captain Bradley said. “When he walks in the door,
it’s a lift for everybody. We can always use his quality
on the ﬁeld, in terms of on the left side, whether it’s
as a left back, as a left midﬁelder. His speed, his quickness and his football — he has a football brain.”
A speedy midﬁelder for most of his career, Beasley
had not played left back for the national team in four
years before he was inserted there by Klinsmann for
the Snow Clasico World Cup qualiﬁer against Costa
Rica in March 2013.
If Beasley starts at left back in the Gold Cup, Klinsmann could shift Fabian Johnson to right back or
move Johnson to midﬁeld.
“The last like probably four years, I played every
game like it was my last,” Beasley said. “The way I
train, the way I go about the games, my whole mindset is that I play every one like it’s my last.”
Klinsmann wanted Beasley’s arrival to shake up the
younger players.

Bowlsby doesn’t believe
Big 12 disadvantaged
DALLAS (AP) — Big 12 Commissioner Bob Bowlsby believes
the conference has to be constantly improving after getting left
out of the ﬁrst College Football
Playoff.
That doesn’t necessarily mean
making the 10-team league bigger
through expansion.
“We have to recruit better. We
have to develop better. We have to
play better,” Bowlsby said Monday in his annual address to open
football media days. “We have to
win the big games when we have
a chance to win the big games.”
But Bowlsby doesn’t see the
league at any real disadvantage
with only 10 teams, despite

the Big 12 is “psychologically
disadvantaged” as the smallest of
the ﬁve power conferences and
should strive to again have 12

Lions Club will be holding its 17th annual
golf outing on Saturday, July 25, at Cliffside Golf Course in Gallia County. The
event will be a four-man scramble format
with a blind draw and will also have a
shotgun start of 8:30 a.m. The cost is $50
per Cliffside member and $60 per nonmember, and all proceeds beneﬁt Lions
projects. Prizes will be awarded to ﬁrst,
second and third place teams, and there

victories, an astounding
record and a reminder

Johnson was in tears
when he was interviewed
off the green.
“I’m grateful. I’m
humbled. I’m honored,”
Johnson said. “This is the
birthplace of the game,
and that jug means so
much in sports.”
On a tense afternoon of
shadows and showers on
the Old Course, Johnson
closed with a 6-under
66. He was the ﬁrst in at
15-under 273.
Leishman, who considered giving up golf in
April when his wife nearly died of a rare respiratory illness, fell out of the
lead with a bogey on the
16th hole. He had a birdie

putt for the win on the
18th that was wide left
and gave him a 66. Oosthuizen made a 10-foot par
putt on No. 17 to stay one
shot behind, and he delivered a clutch moment of
his own with a wedge to
5 feet for birdie and a 69
to join the playoff.
It was the ﬁrst British Open playoff since
Stewart Cink beat Tom
Watson at Turnberry in
2009, and the ﬁrst involving more than two players
since 2002 at Muirﬁeld,
the year Woods failed in
his bid for the third leg of
the slam.
Johnson matched Oosthuizen’s birdie on the ﬁrst
hole and pulled ahead
with another birdie on
No. 2. Both made bogey
on the 17th — Oosthuizen by missing a 5-foot
putt to tie Johnson —
and the South African
had one last chance.
Oosthuizen, who won the
British Open when it last
was at St. Andrews in
2010, had a 12-foot birdie
putt to force sudden
death. It touched the left
side of the cup and kept
going, and Johnson was
introduced as the “champion golfer of the year.”
Spieth showed guts

over the ﬁnal two hours,
and class when his bid
was over. He stuck
around to hug Johnson
before he walked over to
get his trophy.
Just two weeks ago,
Spieth went to Iowa to
take part in a charity
event for Johnson before
playing — and winning
— the John Deere Classic. He was questioned
for not coming over to St.
Andrews to prepare for a
rare occasion of attempting the Grand Slam. Spieth put that to rest with
a performance that kept
him around the lead all
week.
It was the ﬁrst British
Open to end on Monday
since 1988 because of a
brief rain delay Friday
morning and 10½-hour
wind delay on Saturday.
But what a show. With
14 players separated by
three shots, no one seized
control the entire day.
Eight players had at least
a share of the lead at one
point. Most of them fell
away.
Spieth kept a golﬁng
nation in suspense until
the very end. Now, he
goes to the PGA Championship with a tiny piece
of history left to chase.
