A second chance
at Christmas
By Lindsay Kriz

MIDDLEPORT — On Dec. 1 at about 2:30 a.m.,
the Middleport Police Department responded to a
call about a crashed car in the middle of a field off of
Bradbury Road.
The car, which was stolen from the local Taylor
family, hit two telephone poles and everything inside
the vehicle was ejected and destroyed, including
Shawn and Hallie Taylor’s Christmas presents for
their three children.
Patrolman Leif Babb, one of the officers who
responded to the call, knew he had to do something
to help the family out, Chief Bruce Swift said.
“He felt it was a real sad thing, that something this
tragic would happen at this time of the year,” Swift
said.
Babb said the investigation is still ongoing. With
his help, and the help of the Middleport Police
Department, monetary donations came in from
multiple local people and businesses that allowed
the department to purchase presents for the three
children.
Donations were given by Dunbar and Fowler
Injury Attorneys of Parkersburg, W.Va., Steven, Blake
and Meghan Hudson, Rebecca Miller and Babb,
of Guysville, Mary Schuler, of Middleport, Steve,
Katie and Pam Hartenbach, of Pomeroy, Bruce and
Angie Swift, of Middleport, Mony Wood, of Racine,
Tom Hoffner, of Middleport, the Middleport Police
Department and Fox’s Pizza.

Patrolman Babb and Pam Hartenbach, dispatcher, both helped
donated to the gifts seen here. The gifts went to the Taylor
family, whose car was stolen Dec. 1 and crashed nearby,
causing all the Christmas presents within to be destroyed. The
investigation is pending, Babb said.

LETART — As young
Brandon Cundiff of Letart
lay dying in the hospital
earlier this year, his greatest fear was being forgotten.
This Christmas season, however, family and
friends of the 18-year-old
were determined that was
not going to happen. In

THEIR view

Don’t let
cyberbullies
become censors
It’s as if life imitates art: A despotic foreign
regime uses cyberattacks to bully a major
media corporation from releasing an American film about that despotic foreign regime.
The movie is a fictional comedy, but the
situation is real — and no laughing matter.
Indeed, the decision by movie theaters and
Sony Pictures to cancel the Dec. 25 release of
“The Interview” in the face of undefined terrorist threats is an appalling act of cowardice
that sets a frightening precedent.
Recently, computer hackers widely suspected to be working on behalf of North
Korea stole a bunch of emails and digitized
documents from Sony as retribution for “The
Interview,” a movie starring the popular comedy team of Seth Rogan and James Franco. It
depicts them as bumbling journalists drafted
by the CIA to assassinate North Korean dictator Kim Jong-Un.
Perhaps that plot is tasteless and unfunny,
although it’s hardly the first movie to lampoon the loony leader. That doesn’t justify
cybertheft, nor what happened next: The
hackers threatened terrorist attacks against
theaters that were going to exhibit the film.
Spooked by memories of the 2012 mass
shooting at an opening-night screening of
“The Dark Knight Rises” in Aurora, Colo.,
that killed 12 people and wounded 70, the
nation’s top five theater chains decided they
would not show “The Interview.” Sony then
pulled the film from release — in independent theaters, streaming online, anywhere.
This despite the fact there was nothing specific about the threats, and the Department
of Homeland Security declared “there is no
credible intelligence to indicate an active
plot against movie theaters within the United
States.”
It got worse. Three theaters announced
that in place of “The Interview” they would
screen the 2004 film “Team America: World
Police,” another comedy that mocked, and
killed, Kim Jong-Un’s father, Kim Jong-Il
(portrayed in marionette form). However,
Paramount Pictures, which owns the movie,
ordered the theaters not to show it, apparently afraid of offending the pro-Pyongyang
hackers.
So all it took to bring the entertainment
industry to its knees was a bunch of Internet
bluster. Kim Jong-Un 1, Hollywood 0.
Expect that score to worsen, as anyone
with a gripe about a movie or TV show, book
or song now has incentive to anonymously
threaten its producers and distributors into
censoring it.
This is known as the “heckler’s veto,” and
generally has been deemed by the Supreme
Court as an unconstitutional reason for government to suppress free speech. Private
entities, though, are free to act on what they
consider their best interests.
Sony et al. should rethink what theirs are.
Caving to such a provocation will only invite
further attacks, as rewarding bad behavior
encourages more bad behavior. That will
affect the quality of their products and their
bottom lines.
At the very least, Sony should make “The
Interview” available to watch online or on
DVD; viewing it should be considered an act
of defiance. Stand up for free speech and a
free society, and against cyberbullies and terrorists.

Their view

This time, ‘free speech’ cannot prevail
By Laura Finley

For Ohio Valley Publishing

Like many in the U.S, I normally
consider myself a staunch advocate
of free speech and against most
forms of censorship.
I agree with a previous U.S court
of appeals decision that determined
a Facebook “like” was constitutionally protected free speech. As a
longtime anti-domestic violence
activist, though, I am deeply concerned about the use of social media
to harass and abuse others. A decision in favor of Anthony Elonis in
Elonis v. United States, expected in
summer 2015, will have potentially
grievous implications for the safety
of persons in abusive relationships.
Elonis was convicted of making
threats against his estranged wife,
Tara, and also later an FBI agent.
He was sentenced to 44 months in
prison. He utilized his Facebook
page to issue a series of disturbing rants after his wife left him.
“There’s one way to love ya, but a
thousand ways to kill ya, And I’m
not going to rest until your body is
a mess, Soaked in blood and dying
from all the little cuts. Hurry up and
die b——.”
Concerned that Elonis would act
on these threats, Tara sought and
obtained a restraining ordering her
husband to cease posting threatening or harassing comments or from
contacting her directly or indirectly.
Anthony persisted posting this
comment three days after the court
hearing: “Did you know that it’s
illegal for me to say I want to kill
my wife?” he wrote, explaining,
“Now, it was okay for me to say it
right then because…I’m just letting
you know that it’s illegal for me to
say that.” A week later, he posted
this: “Fold up your protective order
and put in your pocket. Is it thick
enough to stop a bullet?” Carrying

on, Elonis posted the next day that
he intended to “make a name for
himself” with “the most heinous
elementary school shooting ever
imagined. Hell hath no fury like a
crazy man in a kindergarten class.
The only question is…which one.”
It was that post which got the
attention of FBI agent Denise Stevens, who then visited Elonis at
home. He posted this after she left:
“Little agent lady stood so close.
Took all the strength I had not
to turn the b—— ghost. Pull my
knife, flick my wrist, and slit her
throat. Leave her bleedin’ from her
jugular in the arms of her partner.”
Elonis maintains that he was
merely exercising his free speech
rights in the same fashion as have
many musicians, most notably rap
artist Eminem, whose lyrics have
expressed fantasies about killing
his ex-wife. At issue is whether the
judge erred in telling the jury that
they should determine whether
Elonis’ posts were true threats by
using a “reasonable person” standard.
In his appeals, Elonis has contended that the jury should have
been asked to determine whether
Elonis himself actually intended
for his words to be threatening,
not whether any reasonable person might believe them to be. His
attorney notes that Elonis posted
disclaimers on his page expressing
that he did not intend to threaten
his wife, merely to express himself
and to entertain.
Federal prosecutor Patrick
Fitzgerald, and domestic violence
advocates, disagree. They note
that the fact that Elonis posted
the remarks after Tara obtained a
restraining order and posted them
without restrictions shows that he
was trying to send her a powerful
message.
Without a doubt, the most lethal

time in an abusive relationship is
when the victim attempts to end it,
as Tara did by first leaving Anthony
and then obtaining the restraining
order. All of the lethality assessments used by police and domestic
violence advocates include questions about the frequency and
nature of prior threats. Further,
Cindy Southworth, vice president
of the National Network to End
Domestic Violence, noted that “We
have stalking statutes all over the
country that are based on a reasonable person versus proving the
intent of the stalker or abuser.”
A survey conducted by the Safety
Net Project at NNEDV found 90
percent of domestic violence programs had victims seeking help for
online or digital threats. A 2013
study by the Urban Institute found
more than a quarter (26 percent)
of youth in a relationship reporting
that they had experienced some
form of cyber dating abuse in the
prior year. Additionally, social
media posts have been introduced
as evidence in numerous court
cases, in particular those regarding
domestic violence and stalking.
So far, comments and questions
from the justices suggest that they
may be learning toward interpreting Elonis’ posts as threatening,
with Justices Ginsburg and Alito
noting the difficulty of “getting into
the mind” of someone who posts
something on social media.
Although free speech is an
important human right, decades
of knowledge about the cycle of
domestic violence and warning
signs of potentially lethal behavior
should indeed prompt the Court
to rule against Elonis. To do otherwise undermines all that we know
about abusive behavior and puts
victims in serious jeopardy.

WV getting ‘smoked’ by tobacco marketing
CHARLESTON, W.Va. — With tobacco companies spending more than $120 million to market
their products in West Virginia — nearly 25 times
what the state spends on tobacco prevention programs — is it surprising that West Virginia has the
highest smoking rates in the United States?
No, at least not according to the Coalition for a
Tobacco-Free West Virginia, where tobacco annually claims 4,300 lives and costs the state $1 billion
in health care bills. Reports show each year 2,200
additional West Virginia kids become smokers.
“… It is critical that the state raise its tobacco

tax and increase funding for tobacco prevention
programs,” said Matthew L. Myers, President of the
Campaign for Tobacco-Free Kids, explaining that
evidence shows tobacco prevention and cessation
programs work to reduce smoking, save lives and
save money.
West Virginia will collect $170.1 million in revenue this year from the 1998 tobacco settlement
and tobacco taxes but will spend only 2.9 percent
of the money on tobacco prevention programs. The
state spends only $4.9 million per year on tobacco
prevention and cessation programs, which is 17.8
percent of the $27.4 million recommended by the
Centers for Disease Control and Prevention (CDC).
The state ranks 22nd in the country in funding
the programs that prevent kids from smoking and
help smokers quit, according to a national report
“Broken Promises to Our Children: A State-by-State
Look at the 1998 State Tobacco Settlement 16
Years Later.”
Coalition officials say significantly increasing

the tax on tobacco products is proven to be a most
effective strategy to prevent kids from starting and
helping smokers quit.
To reduce tobacco use and its health and financial
toll in West Virginia, health advocates are calling on
state leaders to increase the state cigarette tax by
$1.50 per pack, along with a similar increase to the
tax on other tobacco products.
“These strategies are proven to reduce tobacco
use and its terrible toll in health, lives and dollars.
Until West Virginia leaders act, the state’s kids
and taxpayers will continue to pay a high price”
stated Cinny Kittle, director of the Coalition for a
Tobacco-Free West Virginia. “Because we have such
high rates of tobacco use, including a rate of smoking among pregnant women that is three times the
national average, we must apply these proven strategies in our state.”

victory Tuesday night during a 44-42 decision
over visiting Nelsonville-York in a non-conference
matchup in Meigs County.
The host Tornadoes (4-2) — fresh off their
59-57 win over Wahama on a Jack Lemley putback
at the buzzer Friday night — rekindled a little
of that home
magic against
the Buckeyes,
only this time
the roles were
a bit reversed
in reaching the
final outcome.
Wolfe
attempted a
three-pointer
that missed
the mark in the
Wahama game,
which ultimately fell into the hands of Lemley for
an offensive rebound and successful layup right
before the final horn. Tuesday night, however,
it was Bradley McCoy that attempted a gamewinning two — only to have the shot blocked back
into the hands of a wide-open Wolfe behind the
arc.
Wolfe hauled in the offensive carom, squared
in on his target and let the ball fly just before the
final buzzer sounded. The shot hit nothing but
net, which launched a frenzy of cheers from the
home crowd en route to the two-point triumph.
NYHS (3-4) — which has now lost four straight
— fought an uphill battle just to get itself in a
position to win the game late, as the guests made
a 15-4 fourth quarter run to claim a 42-41 edge
with under a minute left in the contest. SHS was
ultimately outscored 15-7 down the stretch, but
Wolfe’s trifecta made that moot point afterwards.
Southern led 14-5 after eight minutes of play,
then went on a small 11-9 second quarter spurt
to secure a 25-14 edge at the break. The Purple
and Gold kept that momentum going with a 12-5
charge in the third canto, which gave the hosts
commanding 37-27 advantage.
The Tornadoes connected on 18-of-49 field
goal attempts for 37 percent, including a 3-of-12
effort from three-point range for 25 percent. SHS
also committed 15 turnovers and made 5-of-8 free
throw attempts for 63 percent.
The hosts were outrebounded by a 35-23 overall
margin and had team totals of eight steals, seven
assists and one blocked shot.
Wolfe led the Tornadoes with 12 points and
seven rebounds, followed by McCoy with 11
points and team-highs of four steals and three
assists. Jack Lemley was next with nine points,
while Crenson Rogers added six markers to the
winning cause.
Dylan Smith, Theron Johnson and Ryan
Schenkelberg rounded out the SHS scoring with
two points apiece.
Colt Adams paced Nelsonville-York with a
game-high 16 points, followed by Brayden Withem
with eight points and Hunter Edwards with six
markers. Jeremy Warren and Jay Elliott also had
three points apiece in the setback.
Joel Thompson and Aron Davis rounded out
the scoring with two markers apiece. The Brown
and Orange were 4-of-5 at the charity stripe for 80
percent.

POINT PLEASANT, W.Va.
— The Generals never surrendered, but Point Pleasant firmly
held its ground while snapping
a four-game losing skid Tuesday
night during a 57-51 victory
over Winfield in a non-conference boys basketball contest in
Mason County.
The host Big Blacks (2-4)
never trailed in the second half
and led the final 17:33 of regulation, but the Generals (2-2)
refused to go away quietly after
rallying back from a 14-point
third quarter deficit to close to
within 49-48 with just under
two minutes left in regulation.
PPHS, however, hit 6-of-7 free
throw attempts during an 8-3
surge over the final 1:43 of play,
which ultimately allowed the
hosts to turn a slim one-point

edge into the final six-point
margin of victory.
The Big Blacks were outrebounded by a sizable 45-30
overall margin — which included a 15-6 deficit on the offensive glass — while also committing three more turnovers in
the contest. Yet, despite a few
glaring stats working against
them, the hosts never trailed
by more than two points in the
entire game.
With the Big Blacks in the
midst of a four-game losing
spell and Christmas just two
days away, it would have been
real easy for the hosts to not
be focused on basketball. Point
Pleasant, however, showed a
great resiliency and kept a cool
head as it watched a double-digit lead gradually whittle down
to a single point.

CENTENARY, Ohio — The Blue Devils found
themselves on the wrong side of an outstanding

Tigers claim a 74-57 victory over non-conference
host Gallia Academy.
The Blue Devils (1-6) led 12-10 through the

MHS expanded their lead even farther in the

Christie: NBA boss doing a
‘bait and switch’
JERSEY CITY, N.J.
(AP) — New Jersey
Gov. Chris Christie says
a call from the National
Basketball Association
commissioner to join him
in lobbying Congress to
legalize sports betting
across the nation is a
“bait and switch”
Christie said during
a televised interview
Monday night that it was
“kind of crazy” for NBA
commissioner Adam
Silver to ask him to help
with a legalization push
when Silver is part of a
lawsuit blocking sports
betting in his state.
“I think it’s kind
of crazy for the
commissioner of the NBA
to say, on one hand, ‘Join
me governor, let’s have
legalized sports gaming
everywhere. But not in
New Jersey right now,’”
Christie said.
“What I call it, quite
frankly,” he added, “is a
bait and switch.”

Silver supports
overturning the federal
statute that prohibits
most states from
authorizing sports
betting. He repeated his
position during a podcast
interview that aired
Monday on ESPN.
“Gov. Christie, and
I’m happy to join him,
should turn his attention
to Washington, D.C.,
to Congress, and say,
‘Here are all the reasons
it should be regulated,’”
Silver said.
“But let’s come up with
a framework that makes
sense on a national basis,
presumably that would
allow states to opt in,” he
continued, pressing the
need for consistency from
state to state.
But Christie rejected
the premise.
“If Adam Silver
believes that sports
gaming is OK then allow
sports gaming in New
Jersey, allow us to be the
model,” he said.
The NBA, National
Football League, National
Hockey League, Major
League Baseball and
the National Collegiate
Athletic Association sued
Christie in 2012 to block
his attempts to legalize
the practice.

Varejao was helped to

Blatt said he did not

Marshall top NIU 5223 in Boca Raton Bowl
BOCA RATON, Fla.
(AP) — The Boca Raton
Bowl had been over for
less than an hour, and
Northern Illinois coach
Rod Carey was already
thinking about how his
team would bounce back.
The Huskies couldn’t
stop the passing combination of Rakeem Cato to
Tommy Shuler and lost
Tuesday to Marshall,
52-23. “This leaves a
really bad taste in our
mouth,” Carey said.
“What we came here to
do, we did not get done.

That will stick with us
here, and we’re going to
have use that going into
next year.”
Northern Illinois made
25 first downs, gained
425 yards and had an
edge in time of possession. But the Huskies
struggled in the red zone,
and Cato connected with
Shuler on 18 completions
for 185 yards and a score.
“They did a good job

10-of-25 shot attempts
for 40 percent, while the
Generals made just 10-of30 field goal tries for 33
percent.
Winfield ended a 2:39
scoreless drought with
the opening bucket of the
second half, but the Red,
Black and White countered with another 9-0
run over the next three
minutes — allowing the
hosts to take their largest
lead of the night at 39-25
with 4:24 remaining in
the third.
Point, however, committed eight turnovers in
the third canto, and WHS
took advantage of those
miscues by going on a
12-2 surge over the rest
of the stanza en route to
trimming its deficit down
to 41-37 headed into the
finale.
The Big Blacks made
an 8-2 run to start the
fourth, with Sroufe capping the charge with a
basket at the 3:43 mark
for a 49-39 advantage.
The Generals answered
with an 8-0 run that was
capped by a Bear Bellamy
trifecta with 2:11 remaining, making it a 49-48
contest.
WHS, however, never

PPHS connected

Sroufe led the Big

22 points, with 14 of
those coming in the first
half. Brian Gibbs and

with 12 points apiece, followed by Douglas Workman with five markers.
Trey Tucker contributed three points to the
winning cause, while
Brandon Henderson and

scoring with two points
and one point.
Yates led Point with
nine rebounds, followed
by Sroufe with eight
boards and Workman

Winfield sank 19-of-62

effort from behind the
arc for 13 percent. The
guests committed 18
turnovers and also went
11-of-22 at the charity

Bellamy paced WHS
with a double-double
effort of 16 points and
12 rebounds, followed
by Heath Diehl with 14

10 points and 10 caroms.
Alex Osburn was next
with seven points, while
Casey Frye and Johnny

Afterwards, third-year
Point Pleasant coach Josh
Williams spoke about
the maturation that his
troops have endured in
just the last week. He’s
also hoping that this
recent learning process
will continue to benefit
his kids moving forward.
“We’ve had a tough
couple of days over the
past week, but we also
found some of the things
that we were capable of
doing well on a regular
basis. We also realized
some the things that
we needed to change or
improve on,” Williams
said. “The things that we
stressed most were a consistent effort by everyone
and playing smart collectively, and I thought we
did that for the most part
tonight.
“We took some lumps
during that stretch last
week and I think it made
a lot of the kids realize
that we need each of
them to step up a little
more than what they
were already doing.
Everybody contributed
a big piece to this win
and we are going to need
more of that. I am proud
of what I saw out of all of
them tonight.”
There were three ties
and six lead changes in
the contest, all of which
came in the opening
half. The game, however,
proved to be a war of
attrition early on as Winfield committed six turnovers and missed its first
four shots in the opening
three minutes of play —
and still held leads of 2-0
and 4-2.
Brian Gibbs converted
an old-fashioned threepoint play at the 2:16
mark for a 5-4 lead, which
also sparked a 10-7 run
that allowed PPHS to
secure a 12-11 edge after
eight minutes of play.
WHS countered with
a 4-1 spurt to regain
the lead at 15-13 with
4:44 remaining, but the
hosts answered with six
straight points to reclaim
a four-point advantage
with 4:06 left until halftime.
The Generals responded with an 8-2 surge over
the next two minutes
and took their final lead
of the night with 2:11
remaining after Tate Hancock netted a basket for a
23-21 edge.
Trey Tucker netted a
free throw at the 1:52
mark to pull PPHS to
within one, then Cody
Sroufe nailed a bucket
with 1:33 left in the half
that ultimately provided a
permanent lead at 24-23.
Those three points
