Witnesses called in Rizer murder trial

POMEROY - Subpoenas
have been issued to potential
witnesses in the upcoming
tnal of a P01tland woman,
accused in the shooting
death of her husband.
Herman Carson. a public
defender based in the Ohio
Public Defender's Athens

office. has also filed a
motion to prohibit further
testing on evidence to be
presented at the trial of
Paula Rizer.
Rizer's trial is scheduled
to begin Oct. 27. She is
accused of shooting her
husband, Kenny Rizer, Sr.,
five times in the chest at
their home on Lovett Road
in Portland. He was pro-

nounced dead at the scene,
and his wife was arrested
just hours after his death.
Rizer has been in the
Washington County Jail
since she was atTested. Judge
Fred W. Crow III denied a
motion to reduce her half
million-dollar cash bond.
Carson filed a motion on
Oct. 9, to prohibit prosecutors from pet:forming fur-

ther forensic testing on the
clothing of Rizer's husband.
He said he has tried for
weeks to obtain access to
the clothing Rizer was
wearing at the time of his
death. and discovered last
week that the clothing has
been in the custody of the
Montgomery
County
Coroner
since
Rizer's
autopsy.

Carson said he had
planned to view the clothing
last Friday when he visited
the coroner's office to view
Rizer's autopsy records. and
bring the clothing back to
Meigs County.

Pomeroy Village
Council passed the third and final reading of an ordinance Monday which permits Mayor John Musser and ClerkTreasurer Kathy Hysell to sign off c;m a
loan for the remodel and purchase of the
former MillenniUm building on East
Main Street.
Though previous discussions on the
matter have resulted in some contentious exchanges , last night's vote v.·as
relatively quiet and without discussion.
Though the discussion was missing, the
votes remained the same as previous
meetings with Councilwomen Mary
McAngus and Ruth Spaun voting
against the loan while Councilmen Dave
Deem. Jim Sisson and George Stewart
voted for it. Councilman Pete Barnhart
\vas absent.
The 30-year loan agreement through
Farmers Bank is for up to $575.000 with
a 3.25 percent interest rate during the
remodeling period and a 4.l percent
interest rate after the remodel of the former Millennium building. The building is
owned by the Community Improvement
Corporation.
The renovation will divide the building
in half. including separate heating. cooling and electrical systems 'with
Pomeroy's village offices on one side and
Pomeroy Auto Parts on the other.
Pomeroy Auto Parts is paying $2,916 a
month for five years. while the village ·s
loan payment is said to be estimated at
around $2,700 a month which means the
village will actually make some money
from the rent.
As part of the purchase agreement. the
deed to the Pomeroy Municipal
Building will be transfetTed to the CIC
in exchange for a $1 00,000 deduction of
the purchase pnce of the Millennium
building.
Though Pomeroy Auto Parts has
moved into its new home. last night
Musser said he wasn't sure ~hen village
offices will make the move.

POMEROY - For nearly a half century, the
Pomeroy-Middleport Lions Club has been posting
flags of the United States of America along the
streets of downtown Pomeroy in observance of
patriotic holidays.
Yesterday in celebration of Columbus Da). several members were out early getting the flags in
place.
Jt happens eight times a year beginning in
February with Presidents' Day and moving on tp
Memorial Day in May. Flag Day in June.
Independence Day in July. Labor Day and Patriot's
Day in September. Columbus Day in October. and
Veterans Day in November.
Merchants who want a flag placed in front of their
business pay a small fee each year for having the
Lions Club do it. The money is 'used by the Club for
their special project of providing eyeglasses for
those who cannot afford to pay for them.

Lila J. Follet of Parkersburg, W.Va.,
was hired as a class one wastewater treatment officer who will work with the
wastewater and water departments.
Follett will also work under Greg Wilson,
an interim licensed \Xv'ater operator the
village has hired until Follet earns her
license . Follett will be on a 90-day probationary period with a negotiable salary
to start at $35.000.

Chief of Police i\lark E. Proffitt said due
to two departures from the department
and resulting overtime, the hiring was
necessary. Also approved as a full time
dispatcher was Frank Ste,vart. a part time
dispatcher.

Council approved Pomeroy's trick-ortreat time from 6 to 7 p.m .. Thursday.

Council approved the transfer of
$5.000 from the general to street fund.
The latest Mayor's Report was
approved wnh Pomeroy taking in
$11.929.29 in fines and forfeitures.
Parking meters took in $1,988.71: parking tickets. $351: parking permits, $80;
for a total of $2.419.71 collected. There
''ere 119 'parking tickets issued.
Council adjourned into executive session once to dtscuss legal matters at the
wastewater plant. After resuming the regular session. the motion to hire Follet was
made and approved.

Hunter education course offered

Frank Herald Jr., 70, of Rutland. passed away unexpectedly at home on Oct. 10.2009. He was born Oct. 6. 1939.
in Logan County. W.Va .. son of Elizabeth Mack Leighton
of Middleport and the late Frank Herald, Sr.
Mr. Herald was a member of the Middleport Church of
Christ. He enjoyed gardening and farming. He was owner
and operator of many local businesses including the
Herald Oil &amp; Gas Company. He was a member of the
Middleport Masonic Lodge #163; Harrisonville Order of
the Eastern Star# 172: Pomeroy Gun Club; South Eastern
Oil &amp; Gas Association: and the Fraternal Order of Eagles
in Pomeroy #2 171 .
Jn addition to his father. he was preceded in death by a
brother. Warren Herald; mother of fiancee, Charlotte
Erlewine.
He is survived by: his mother. Elizabeth Mack Leighton
of Middleport; his fiancee Dinah Stewart of Middleport; his
children, Lisa Pierce of Tuppers Plains. Robin Anderson of
Ft. Myers. Fla .. Betsy Nicodemus of Reedsville. Cindi
(Ron) Lucas of Athens and Jon Stewart of Langsville;
grandchildren, Travis (Wendy) Pierce of Reedsville.

POMEROY - An Ohio Hunter Education Class will be
held commencing Oct. 26 at the Kountry Resort
Camp&amp;round ~formerly Royal Oak Resort) near Pomeroy.
Sesstons will be held in the b~nquet hall on Monday,
Tuesday and Thursday, Oct. 26, 27 and 29. 6-9 p.m. with
the test being administered on Saturday. Oct. 31. 9 a.m. to
noon. Students must attend all sessions.
The Ohio Hunter Education course includes 10 hours of
instruction in hunter ethics and responsibility. firearms.
archery. first aid and wildlife management and biology.
Classes are free and all materials and manuals are provided
at no cost.

All ~irst-time hunters must successfully complete a hunter
education course offered through the Ohio Division of
Wildlife before purchasing a hunting lic.ense. In addition,
cutTent h~ntin$ license holders who wish to purchase out-ofstate huntmg hcenses m other states must in most cases provide proof of having completed a hunter education course
before they can purchase an out-of-state hunting license.

Beverly A. Porter, 52, of Amherst passed away on
Sunday Oct. I 1, 2009 at Fairview Hospital after a courageous one year battle with ovarian cancer
She was born on Feb. 24. 1957 in Marietta. She was a
1975 graduate of Williamstown High School in
Williamstown. W.Va.
Beverly was employed by Micron Manufacturing in
Lagrange for the past 15 years as a machine operator. She
loved 'nothing more than her husband, children and grandren. She enjoyed cook-oub at her home and spending
\Vith her family and friends.
Beverly is survi\'ed by her husband, Rickie, of 15 years;
•son. Daniel James Buchanan of Amherst; daughter, Billena
(Steve) Porter of Oberlin: step-sons. Rickie (Cathy) Porter
of Wellington, Matthew (Stephanie) Porter of
Wellingtonand Shane Burgess of Grafton: step-daughter,
Misty Porter of Grafton: 12 grandchildren; parents. James

Retired Teachers, held at the Fultz Center.
Luanne Bowman. vice president for financial &amp;nd administrative affairs. Jake Bapst, transitional coordinator. and
Sarah Boothe. administration representative, were the
speakers. They told of how the center came about and of
some of the problems they had before the building could be
used for classes.

The center offers programs in business management.
early childhood development, general studies, information
technology, and power plant technology.
The center is a partner with the county's school system,
and enrollment has been increasing since opening. The
group toured the building.
Mary Gilmore catered the meal to 21 members and two
guests. Rosalie Story had devotions. and read "Teacher."
Gay Perrin had prayer before the meal.
Gay Perrin, president, thanked those who brought in
school supplies for the needy. Secretary and treasurer's
reports were given. Members are reminded that dues are to
be paid as soon as possible.
Joan Corder, scholarship chairman. gave an update on
scholarship recipients since 2000 and what they are doing
now. Students who apply for the scholarship must be
juniors or seniors majoring in education and residents of
. Meigs County, with grade point averages of 2.5 or above.
PetTin noted the deaths of two members, Rachael Downie
and Howard Parker.
Items are still needed for the school room at the Chester
Academy.
Door prizes. donated by Debbie Roush. were awarded to
Glenna Riebel, Bill Downie and Marlene Donovan.
The next meeting will be Oct. 15 at the Wild Horse Cafe.

teams earned home games
following the 2008 sectional tournament drawings for
divisions II, III and IV held
Sunday at Jackson High
School.
Five of the local squads
- Gallia Academy, Meigs ,
Eastern, South Gallia and
Southern - will open the
second season at home .
while River Valley will be
the lone OVP school not to
have a home game in the
ostseason.

when things looked to be at
their worst.
And at the end of the day.

twice faced an elimination
match point in' Game 4 - rallied back in a thunderous
manner Saturday afternoon
against Marietta to claim the
2009 Southeastern Ohio
Athletic League volleyball
title with a thrilling 25- I 8, 2325, 16-25, 28-26, 15-7 tiiumph in the first-place match
of the SEOAL Day of
Champions.
The Angels ( 17-4) found
themc;elvcs in big trouble in
that pivotal foUtth game, trailing 18-17 in the race to 25
after dropping two straight

The visiting Lady Tigers
(16-4) then ran off four consecu!ive points, increasing
their edge to 22-17 while
clearly capturing momentum
in the process.

Following a GAHS timeout, the hosts responded with
six of the next seven points to
knot Game 4 up at 23-all.
MHS countered with a
score and a 24-23lead. setting
up the first of two match
points for the guests. The
Angels, however, retaliated
