Jury must decide whether man
intended to shoot prankster
Bv JOE MILICIA
ASSOCIATED PRESS WRITER

MILLERSBURG, - An
Amish teenager says a man
dared him and other young
people hiding in a cornfield to throw more tomatoes at him, then pulled a
shotgun out of hi s vehicle
and fired three quick
rounds killing a 23-year-old
man .
Joseph Yoder testified
Wednesday in the murder
trial of Marion Weaver.
Weaver's attorney, John
Johnson Jr., is not disputing that Weaver fired the
shots that killed Steven L.
Keirn, of Apple Creek,
after his car ·was hit with
tomatoes.
Johnson said Weaver was
trying only to scare those
who pulled the prank and
didn't know anyone was in
the cornfield when he
fired.
.
"Marion Weaver is no
murderer," Joh nson told
jurors during his opening
statement.
Throwing tomatoe s at
passing vehicles is an
in
the
annual
prank
Holmes-Wayne
County
area, which has the largest
Amish settlement in the
world.
Yoder, 17, testified that
he had thrown tomatoes in
past years, even from the
same cornfield where Keim
was killed Sept. I.
After Weaver's Cadillac
was struck by tomatoes
and pai ntballs on the rainy
Labor Day eve ning, he
returned about 25 minutes
later.
Yoder said he was lying
nat on his stom ach in the
first row of corn when the
car returned and drove past
the field two times. It
stopped on a thi rd pass
and a man got out.
"He
just
screamed.
' Throw at me you (expletive),"' Yoder testified.
No
tomatoes
were
thrown, Yoder said. The
inan then reached inside
!he vehicle for a shotgun
and fired into the cornfield.
Assistant Hohries County

Prosecutor Steve Know ling
said Kei m was struck by
more than I00 pellets fro m
· head to toe and was fatal ly wo unded in the heart.
"No one deserves to be
shot like that for throwing
tomatoes,'' he said.
He told jurors dt1ring his.
opening
statement
that
Keirn's death was no accident.
"Thi s happened because
the defendant took it upon
himself to teach a lesson
to Steven Keirn and his
friends for messing with
Marion Weaver,'' he said.
About 25 family members and fri ends of Keim
stared
unninchingly as
Knowling showed j urors
four bloody photos of the
victim's body on a large
television .
Weaver, 58, of Benton,
could get 18 years to life
in pri son if convicted of a
murder charge.
John son
noted
that
Weaver did not learn about
Keim 's death until the next
day. Weaver then suffered
a near-fatal heart attack
and had heart s ~rge ry at
Mercy Medical Center in
Canton.
"The shock of that news
almost
killed
Marion
Weaver," he said.
Johnson said Weaver has
spent ye?rs delivering ice
to the Ami sh in Holmes
Count y and has built a
re lationship with members
of the community. He also
was friends with Keim's
family and was horrified
whe n he learned what happened, he said.
Keim 's fam ily was once
Amish but later converted

faith.

Eight teenagers, ages IS
to 17. and th ree men, ages
20, 2 1 and 22, rleaded
guil ty to vehicular vandalism in the prank. The
juveniles were sentenced to
serve a weekend in juvenile detention and fi ned
$250 each . The <tdults were

STAFF REPORT
SPORTS@MYDAILYTRIBUNE.COM

RIO GRANDE - University of Rio
Grande Head Softball Coach David
Pyles stayed close to home to sign his
third recruit for the 2005 season with the
signing of Jackson High School standout Whitney Harless to a letter-of-intent.
Harless, a 5-7 catcher, also has the
versati lity to play elsewhere. She can
play the outfield and has played shortstop at the prep level.
This season will be her fourth year of
playing softball tor the lronladies. Harless
gamered 2nd team AII-Disuict honors two
years ago and was Ist team AII-SEOAL
and Ist team Ali-Disuict last season.
Harless was happy to sign with Rio
Grande. "It's a great feeling," Harless
said. "It's exciting to know that I'll be
able to go play college ball next year.
" It also kind of takes some weight
off my shoulders, so I can just enjoy
the rest of my senior year and hopefully have a great season," s~e added.
The newest · Rro recruit mentioned
her reasons for choosing to play for the
Redwomen . "I really liked the campus,
I

it's kind of like its' own little community." she said. "It's close to home
also. so I liked that and other than that
I think they have a great softball program with a good group of girls and a
really great coach."
Harless fhose Rio Grande over
Shawnee State.
.
Harless also stated that she is familiar with some of her new teammates
having played in the Rio Grande winter league the past two years.
Jackson High School Coach Tim
Shook was also happy for Harless and
had high praise for her skills on the
diamond.
"I was lucky enough to be able to
write her name on the Iine-up card, she is
just an excellent softball player," Shook
said. "She's a hard worker, willing to
learn, last year was the first time she had
ever caught behind the plate before and
just picked that up and just absorbed
everything that I could teach her.
"She's got a lot more to learn (about
catching), but I think anything she puts
her mind to. she can do it."
Shook sees .this signing as. something
that can benefit the program long term.

"I think su. I think a good example
around here. if you look al what happened with Oak Hill basketball after
Jamie Lewis went tu Ohi o State. it just
blossoms tu your youn ger programs."
Rio Grande has been lhin at catcher
the past two seasons, so wi th the addition of Harless. Coac h Pyles is
relieve<.! to have a player of her caliber
in the fold . "We were tickled lo death
to get to sign a local kid of the caliber
of Whitney,.. he said . "She's an exceptinnal you ng lady. good in the classroom and jLJst polite and mannerly."
"She has a good frame , very good
sized kid aml she's athletic,'' he added.
"Whitney is another nne, I'm bringing
her in as catching number one. but I
haven ' t ruled out the fact that she may
even look at the corner positions and
possibly eve n outfield, if need be."
She plans to major in Radiology.
Whitney is Ihe daughter of Rich and
Kim Harless of Jackson.
She joins Canal Winchester's Talya
Gi ll espie and Middletown Bishop
Fenwick's Jenny Phillips as the newest
recruits for' the Rio Grande women's
softball squad .
