RUTLAND - A RllllatJd man was released from St. Mary's
Hospital in Huntington, W.Va ., and subsequently from county
c u~tody late Thursday, after allegedly nttempthlg to hang himselfin a cell at the Meig• Counry Jail.
Levi McGrath, 21, allegedly tore a sheet and attempted to
hang himself in his jail cell, according to Mciw County SheriIf ll..alph Trussell . Another prl!oncr yelled for help and
,McGrath W;u .flown to the Huntington hospital by mediCal
helkopter.
"Apparently, the medics thuught (McGrnth'•) cundition wa~
worse that! it was, si nce he was tlown out," Trussell sa id,
"because he was released later in the even in~ ."
McGrath was jailed earlier this week on a parole violation,
Tru!!ell said, and when his hanging attempt was discovered,
both the Adult Parole Authority and County Court Judge
Steven L. Story r~leased McGrath from the cou nty 's care.
"The county ha. been paying a lot of cxpcn~ive doctor bills
for McGrath and for othen,"Trussell said, "and the co unty can't"
afford that ."

The problem I refer to is
malpractice insurance premiums. Malpractice insurance
rates reflect the doctor's training, type of practice, the type
and number of procedures
done, and the histoty of previous claims. In addition, sonl'c
states have Jaws that limit the
size ofawards juries can impose

charge. These variables arc conside red when a malpractice
ins\trance company quotes a
rate to an individual physician
or physician group. Considering this, I'll draw my examples
from my part of Ohio even
though other areas will have
different particulars. .
An average family physician
can expect to pay about
$11,000 in malpractice imurance premiums this year as
compared to $7,000 last year. A
family doctor who delivers
babies can expect to pay at least
$30,000 to over SSO,OOO for
insurance coverage. Ob/gyn,
general surgery, radiology, pediatrics and other specialty grou~
are also being pummeled by 15
to 25 percent mid-year · price
increases. Think .about it this
way. If you're having a baby, and
your doctor deliven one baby
per week, $1,000 of the doctor
bill for your delivery could easily be spent on in.1urance premiunu. Wowl .

ruling: Justice still reigns in the rainy state, thanks to a
judge with a fondness for the rule of law.
On Wednesday, this lone federal judge took a slap at
Attorney General John Ashcroft for snubbing the will of
the people of Oregon. And what do Oregonians want?
Only the opportunity to decide how they'll live and die.
This is pretty much what all Americans want, and U.S.
District Judge Robert Jones wisely affirmed their right to.
have it.
The ruling brushed off Ashcroft's quest to topple
Oregon's voter"a~proved law permitting doctors to help
terminally ill patients choose an easier death. Insisting
that death-hastening prescriptions don't fulfill a "legiti- ·
mate medical purpose," Ashcroft acted last November to
ban them and punish doctors who write them.
Jones won't stand for it.
No statute of any sort, Jones found, authorizes the
attorney general to decide how doctors should practice
medicine. Thus Ashcroft had no business substituting his
judgment for that of Oregon's citizens- who, the judge
noted, "have chosen to resolve the moral, legal and ethical debate on physlcllln·nssisted suicide for themselves
by voting - not once, but twice - in favor of the
Oregon act."
That settles that - for the moment, at least.
Oregonians remain free to live and die by their own
rights without fear of federal rreddling - unless
Ashcroft opts to appeal Jones' ruling.

The press of Cl!lamity in this still-new
century may turn thoughts of even the
most progressive to a quieter time, an
earlier era when the "pioneer spirit" was
not just a metaphor but an indomitable
reahty transfonning endless wilderness
into a brilllunt new nation. Long ago, no
later than 1880, say, 1883, to be precise.
In the summer of 2001, PBS recruited
three families to help re-create that year
for "The Frontier House," a reality- TV
series that aired thi~ week.

and no "peace process" - was 1883
just about heaven on earth?
Not exactly, according t.o California
wife and mother of three Adrienne
Clune, 40, who discussed the making of
"The Frontier House" in Victoria magazine. "My expectations were so far from
reality," she told the fetchingly decorative periodical. "I dreamed about having all this time to do quilting and enjoy
the countryside."

The Nets su~ved a q~estionable
game- tying 3-pomter by Miller at. the
e nd of regulation Thursday night to defeat the India~
Pac~n 120-109 night in a riveting Game 5 of thetr
first- round series.
Jason Kidd scored 20 of his ·J I points - a c~reer
playoff' high - in the fourth quarter and two ~vertunes
for the N ets, .who won their first playoff senes m 18

There were dozens of plays to remember, the most
dramatic being the 35-foot tUrnaround 3-pointer that
Miller banked in near the buzzer to m:tke it 96-96.
One TV replay showed that it barely beat the clock,
while another showed the ball in his hands with the red

It didn't because Kidd showed all hiS MVP-type
qualities in refusing to let the Nets lose. He eventually
helped put the game away, igniting a 5-0 run at the

had 27 before fouling out as th~ Nets advanced to a
best- of- seven Eastern Conference semifinal against the
Charlotte Hornets, starting in New Jersey on Sunday.
